We have had some crazy and surprising fashion law headlines this week so I wanted to take a minute to talk about two of them with y’all.
First, and definitely most disturbing, Zara got sued this week…but the reason why is probably not what you would think. In fact, if I gave you 5 guesses, I still don’t think you’d get it. Warning: very disgusting. Brace yourselves for what you’re about to read.
A woman found A RAT sewn into her dress. Yes, you heard that right. She sued Zara in New York state court for negligence (which basically means carelessness) and is seeking damages. She alleges that she bought the dress in Greenwich, Connecticut in July and wore it for the first time in August. She noticed a “pungent odor” following her around and felt something brush her leg. When she reached down to inspect the dress, she found a big bulge in the hem and that’s where she saw the rat.
EW!! Ew, ew, ew. I am cringing at the thought of this. And I’m also wondering how this woman put on a pungent smelling dress to wear to work.
Will she prevail on her negligence claim?
Well, I can’t tell ya that. But, generally to prove negligence you have to prove: (1) the defendant (Zara) owed a duty to the plaintiff (consumer); (2) the defendant breached that duty; and (3) the breached caused the plaintiff damages (3 is really 3 and 4 - causation AND damages, but we’ll save that lesson for 1L year of law school).
Second big news to share with y’all, Nasty Gal filed for bankruptcy. But don’t freak out. This doesn’t mean it’s closing tomorrow, or any time soon. Nasty Gal filed for Chapter 11 bankruptcy, which is a restructuring. That means that Nasty Gal wants to keep the business alive and pay their creditors over time. I was actually surprised that Nasty Gal filed for Chapter 11 after all of her book success and it seemed like they had just raised a bunch of capital a few years ago. Guess you never know.

Both of these stories was so surprising! I can’t say I inspect every piece of clothing I buy, but I might have to start to make sure there aren’t any extra “friends” in them!
